Scope of Representation
While there is no single standard for trademark representation, the legal services provided by attorneys often vary based on experience, practice philosophy, and the complexity of the matter. The information below describes the scope of representation included in our Trademark Registration Package.
Our Trademark Registration Package covers the legal strategy, research, analysis, preparation, filing, and legal management of your federal trademark application throughout the trademark prosecution process. It also includes the initial USPTO filing fee for one class. If the USPTO requires additional substantive legal work, or if you decide to expand the filing into additional classes or foreign jurisdictions, those services and government fees are billed separately. Likewise, legal issues such as Office Actions, special regulatory approvals, appeals, opposition proceedings, cancellation proceedings, or other matters requiring legal services outside the scope of the Trademark Registration Package are billed separately. While many trademark applications proceed without these issues, every application is subject to review by the USPTO and circumstances may arise that require additional legal representation.
Our goal is to help you secure a federal trademark registration that can become one of your business's most valuable intellectual property assets and, when properly maintained and continuously used, can remain in force indefinitely.

Questions new clients ask
The federal trademark prosecution process, from your initial strategy call to receipt of your federal trademark registration, can take 18 months or longer depending on the legal issues present in your unique file.
Business structuring matters typically take 30 to 90 days depending upon the complexity of the business structuring needs of each client.
For trademarks, a specimen or proof of use, the mark itself, and a description of goods/services. For business structuring, we'll request identification, entity name choices, and ownership details. For IP trusts, a list of the IP assets to be transferred. Your intake questionnaire will guide you item by item.
You'll receive a calendar confirmation and a short intake form. At the call, we'll discuss your goals and outline the legal strategy. Afterward, you'll receive an engagement letter and retainer invoice to formally open your file.
Strategy calls are conducted via Zoom or phone, whichever you prefer. They last up to 60 minutes and are led by your attorney. Come prepared to discuss your brand, business structure, or enforcement issue. This is where your legal roadmap is built.
All invoices should be paid on time. After a 5 day grace period, a late fee will apply. Once an invoice is 30 days or more late, all legal work ceases and we reserve the right to retain payment for legal work already performed, as well as the option to suspend all work until payment is made. If payment is not made within a reasonable time, the attorney may exercise the right to discontinue serving as your legal counsel.
